Is Airbnb legal in a Malaysian condo in 2026? The by-law, the Penang ban, the KL rules and the real numbers
Airbnb is not illegal in Malaysia, but it is illegal in any strata building whose management has banned it - and most residential condos in the Klang Valley have. The Federal Court held in Innab Salil v Verve Suites Mont' Kiara Management Corporation (2020) that a management corporation may pass house rules under section 70 of the Strata Management Act 2013 prohibiting short-term rentals, and such rules are enforceable. On top of that sit local rules: Penang's Private Homestay (Penang Local Authorities) By-Laws 2026 took effect on 1 August 2026, with licensing compulsory from 1 November 2026 and MBPP barring short-term stays in residential strata altogether; DBKL requires short-stay operators to register and treats residential zones as off-limits unless licensed - and a council licence never overrides a building ban.
Commercial-title serviced apartments, SOHO/SOFO/SOVO units and buildings whose owners have voted to allow it are where short-term letting legitimately lives. Even there, the January 2026 KL market data - about 59% occupancy and RM237 average nightly rate - and management fees of 20-30% of revenue mean the income is a business, not a yield.
Which law actually decides whether my condo can be an Airbnb?
Three layers, and you need a green light from all three.
| Layer | What it says in 2026 | Where to check |
|---|---|---|
| 1. Your building's by-laws / house rules | JMB or MC can ban short-term rentals outright | Management office: house rules, AGM resolution |
| 2. Land title and zoning | Residential-title condos are zoned residential | Title search (how to check your title) |
| 2. Zoning - Penang island (MBPP) | Residential strata condos excluded | Serviced apartment vs condo |
| 2. Zoning - Seberang Perai (MBSP) | Allows a wider list | Title search |
| 2. Zoning - KL (DBKL) | Residential zones not permitted unless licensed | Title search |
| 3. Local council licensing - Penang | MBPP/MBSP licence compulsory; apply by 1 Nov 2026 | Council website; Penang Property Talk summary |
| 3. Penang - application fee | RM50 | Council website |
| 3. Penang - yearly fee, up to three rooms | RM1,000 a year | Council website |
| 3. Penang - extra rooms (max two) | Plus RM200 per extra room | Council website |
| 3. Penang - TIP fee per unit | RM1,800 a year | Council website |
| 3. Penang - JMB/MC consent | 75% special resolution | Council website |
| 3. Licensing - KL (DBKL) | Register with DBKL via elesen.dbkl.gov.my (free at launch) | Council website |
| 3. Licensing - Selangor | No state licence | Council website |
- 1. Your building's by-laws / house rules: The ban is by house rule under s.70 SMA 2013 (Federal Court, Innab Salil v Verve Suites, 5 Oct 2020). Breach draws fines under the building's rules and, for repeat offenders, court action; access cards get deactivated in practice. Ask the management office for the current house rules and the AGM resolution before you buy.
- 2. Land title and zoning: Residential-title condos are zoned for residential use; commercial-title serviced apartments, SOHO/SOFO/SOVO are not.
- 2. Zoning - Penang island (MBPP): Penang's MBPP now permits TIP (private short-stay) in strata only in serviced apartments, SoHo/SoFo/SoVo, suite and duplex offices - residential strata condos are excluded, while individual-title landed houses may be considered with a change-of-use application.
- 2. Zoning - KL (DBKL): DBKL prefers commercial or mixed-use buildings and treats residential zones as not permitted unless licensed.
- 3. Local council licensing - Penang: The annual TIP fee per unit comes on top of the yearly fee, and JMB/MC consent by 75% special resolution is required. Where to check: Penang Property Talk's August 2026 summary of the MBPP/MBSP lists.
- 3. Licensing - KL (DBKL): Registration comes with a published homestay framework covering fire safety and room caps.
- 3. Licensing - Selangor: MC by-laws and individual councils govern.
The practical order is title first, house rules second, licence third. A commercial-title unit in a building whose owners voted to allow short stays, in a council that licenses them, is a legal Airbnb. A residential condo whose AGM banned it is not, whatever the agent says - and enforcement in KL condos is now routine.
Which buildings can legally run short-term stays - and which cannot?
Commercial title plus owner consent is the combination that works. In descending order of safety:
- Serviced apartments and SOHO/SOFO/SOVO on commercial title, with house rules that allow short stays. This is the Verve Suites category - and note the irony: Verve Suites is commercial-titled, and its MC still banned STR. Commercial title permits it; the owners decide. Read SOHO, SOVO, SOFO vs condo for what else commercial title changes (utilities, assessment, loan margin).
- Residential condos where the AGM has expressly voted to permit STR. Rare in KL, and the vote can be reversed at the next AGM - your business model sits on a 75% special resolution you do not control.
- Residential condos with no rule either way. Legal today, but DBKL's position is that residential zones are not for short stays unless licensed, and one noisy guest is all it takes for the next AGM to ban it.
- Residential condos with a ban, or any residential strata on Penang island. Not legal. Do not buy on the assumption you can "just do Airbnb quietly".
Affordable schemes are excluded everywhere: Penang's by-law bars TIP in low-cost, low-medium-cost, affordable and PPR housing, and RUMAWIP, PR1MA and Rumah Selangorku units all carry owner-occupation or no-subletting conditions - see PR1MA vs RUMAWIP vs Rumah Selangorku.
What does a KL Airbnb actually earn after fees, tax and management?
Less than the brochure, because every input is smaller than the headline. Fetched figures for Kuala Lumpur:
- Occupancy and rate: Airbtics' data as at January 2026 puts KL's average occupancy at about 59%, average daily rate at RM237, and median annual revenue per listing at about RM52,000 - roughly RM4,300 a month gross - across about 20,000 active listings, up 27% in a year. More supply, flat occupancy.
- Platform fee: Airbnb's help centre lists a split fee (most hosts 3%, guests 14.1-16.5%) or a host-only fee of about 15.5% for hosts moved to the single-fee structure.
- Management: Bamboo Routes' 2026 KL analysis cites property management at 20-30% of booking revenue, cleaning and laundry about 16%, utilities about 7% - roughly 46% of gross gone before mortgage, maintenance fees or tax.
- Tax: LHDN treats actively managed short stays as business income (section 4(a)) rather than passive rental (4(d)); the tourism tax of RM10 per room per night applies to foreign guests and is collected by the major platforms. Rates and deductions are in rental income tax in Malaysia.
- Insurance: standard Malaysian fire and householder policies exclude commercial or short-term lodging use; you need a short-stay or landlord policy that covers guest liability, and Airbnb's host cover is secondary.
Run the numbers on RM4,300 gross: after a 15.5% host fee, 25% management, cleaning and utilities, you are near RM1,800-2,000 before the bank, the maintenance fee and the tax return. A long-term tenant in the same unit pays every month with none of that overhead - our rental yield explainer shows how to compare like with like.
Who should not buy a condo counting on Airbnb income?
Anyone whose loan approval depends on it. Banks assess your DSR on salary and, at most, a discounted long-term rent - never on projected nightly income. Beyond that:
- Buyers of residential-title condos. Your permission is a house rule that 75% of your neighbours can remove at any AGM. That is not an asset you can underwrite a 30-year loan against.
- Anyone buying on Penang island for STR. Residential strata is excluded under MBPP's 2026 rules; in strata only commercial-title serviced apartments and office-type units qualify, and landed houses need a change-of-use application.
- Buyers of affordable-scheme units. Owner-occupation and no-subletting conditions apply; breaching them risks the unit.
- Overseas or hands-off owners. The 20-30% management cut plus cleaning is what turns a thin margin into none; the people making money are operators running several units in a building that permits it.
If you still want the option, buy commercial title in a building with a written STR policy, price the unit as if it were a long-term let, and treat any short-stay upside as a bonus rather than the plan. Developer projections of "Airbnb yield" are, by regulation 8(1A) of the housing regulations, not even allowed in a licensed project's advertisement - which tells you how much weight to give them.
Frequently asked questions
Can my JMB or MC really ban Airbnb in my own unit?
Yes. The Federal Court in Innab Salil v Verve Suites (2020) confirmed that house rules made under s.70 of the Strata Management Act 2013 can prohibit short-term rentals, and that this does not breach an owner's right to deal with the parcel. The ban needs a special resolution (75%) at a general meeting.
Is Airbnb banned in Penang now?
Not banned outright, but licensed and restricted. The Private Homestay (Penang Local Authorities) By-Laws 2026 took effect 1 August 2026; operators must hold a council licence (applications by 1 November 2026). On the island MBPP allows short stays in strata only in serviced apartments, SoHo/SoFo/SoVo and office-type units - not residential condos - while individual-title landed houses may be considered with a change-of-use application; MBSP on the mainland permits a broader list.
Do I need a licence for Airbnb in Kuala Lumpur?
DBKL requires short-stay operators to register (elesen.dbkl.gov.my) and has a homestay framework covering fire safety and room limits; its stated position is that residential zones are not for short stays unless licensed. Registration does not override a building's ban.
Are serviced apartments automatically allowed to do Airbnb?
No. Commercial title makes it possible; the building's house rules make it permitted. Verve Suites - the case that settled the law - is a commercial-titled serviced residence whose MC banned it.
How is short-term rental income taxed?
Actively hosted stays with cleaning and amenities are business income under s.4(a) of the Income Tax Act, taxed at your marginal rate with business expenses deductible; passive letting is rental income under s.4(d). Foreign guests also attract the RM10-per-room-per-night tourism tax. Details in our rental income tax guide.
