How to check if a property is freehold or leasehold in Malaysia (and what the title actually says)
Read the "Pegangan" (tenure) line on the land title. Freehold titles say "Selama-lamanya" (in perpetuity) and are usually headed Geran or Geran Mukim; leasehold titles state a lease term and an expiry date, for example "Pajakan 99 tahun", and are usually headed Pajakan Negeri or Pajakan Mukim. Under section 76 of the National Land Code, state land is normally alienated for a term not exceeding 99 years - freehold is the exception, not the rule.
If you do not have the title in hand, a private land search at the state land office shows tenure and lease expiry for a small fee (Selangor lists RM30 for a private search, RM50 for an official one). For a new launch, the tenure is stated in the developer's Schedule G/H sale and purchase agreement and brochure. For a condo without its strata title yet, check the master title - the strata title inherits its tenure.
What do freehold and leasehold actually mean on a Malaysian title?
Freehold (pegangan kekal / milik kekal) means the land is held in perpetuity - there is no expiry date, and the state cannot take it back except by compulsory acquisition with compensation. Leasehold (pajakan) means the state alienated the land for a fixed term; when the term ends, the land reverts to the state unless the lease has been extended. The building you paid for sits on that land, so the lease clock is your clock too.
The common terms are 99 years (the maximum under section 76 of the National Land Code) and, on older or specific alienations, 60 years or shorter. Penang and parts of the northern states also carry colonial-era 999-year leases, which behave like freehold in practice. What matters to a buyer is never the original term - it is the years remaining today. A 99-year lease granted in 1975 has under 50 years left in 2026.
Tenure is a property of the land, not the building type. A landed house can be leasehold and a condo can be freehold. If you are still deciding which to prefer, we have separate guides for condos and landed homes.
How do I read the title document (geran / hakmilik)?
The title tells you in the first few lines. Per valuers Agility's guide to reading Malaysian titles, the four final title forms are:
| Title heading | Issued by | Tenure |
|---|---|---|
| Geran (Form 5B) | Registry of Titles (state PTG) | Freehold |
| Pajakan Negeri (Form 5C) | Registry of Titles (state PTG) | Leasehold |
| Geran Mukim (Form 5D) | District Land Office | Freehold |
| Pajakan Mukim (Form 5E) | District Land Office | Leasehold |
Before survey is complete, the land carries a provisional title - Hakmilik Sementara Daftar (HSD) or Hakmilik Sementara Mukim (HSM) - with a PT (lot sementara) number instead of a lot number. Provisional titles still state the tenure.
Do not stop at the heading. Find these fields:
- Pegangan (tenure): "Selama-lamanya" = freehold. "Pajakan 99 tahun" (or 60, 30) = leasehold.
- Tarikh luput pajakan (lease expiry): only on leasehold titles. Count the years from today, not from the grant.
- Kategori tanah: Bangunan / Pertanian / Perindustrian - a house should sit on "Bangunan".
- Syarat nyata (express conditions) and sekatan kepentingan (restrictions in interest): this is where you find state consent requirements, Bumiputera lot status and any bar on transfer. Bumi lot rules are covered in our Bumi lot guide.
Where can I check if I do not have the title? (state by state)
A land search at the state land office is the definitive check, and in the Klang Valley it is now online. Two search types exist: a private search (carian persendirian) gives you the current register extract; an official search (carian rasmi) is the certified, stamped version lawyers use for a transaction. Either shows owner, title number, tenure (freehold/leasehold), lease expiry date, land area, category, restrictions and any charge (bank loan) on the land.
- Selangor - Portal Awam e-Tanah (etanah.selangor.gov.my, reached via ptg.selangor.gov.my). Fees listed by search providers: RM30 private, RM50 official; a private search result stays viewable for three days from the receipt date.
- Kuala Lumpur - Portal Awam e-Tanah of PPTG Wilayah Persekutuan KL (ptgwp.gov.my). Official searches have been fully online since 27 August 2021, no counter visit needed.
- Penang - PgLAND portal (pgland.penang.gov.my) sells private and official search documents online.
- Johor - iTanah Johor (itanah.johor.gov.my) for land titles; PTG Johor's e-Strata portal handles strata private searches online with JohorPay payment since 25 March 2025.
Cheaper and quicker routes that are usually good enough at the shortlist stage:
- New launch: the tenure must appear in the SPA (Schedule G for landed, Schedule H for strata) and is normally on the brochure and the developer's APDL advertisement. Our project pages show tenure exactly as filed - or just WhatsApp us the project name.
- Subsale: ask the agent for a copy of the title or the seller's SPA; a serious seller has both. Your lawyer runs the official search before you sign anyway.
- Existing owner: your annual quit rent (cukai tanah / cukai petak) bill quotes the title number, which is what the portal search needs.
I am buying a condo - which title do I check, master or strata?
Both say the same thing, so check whichever exists. A high-rise starts life on one master title held by the developer; after completion the land is subdivided and each unit gets its own strata title (hakmilik strata), which carries the tenure of the parent land. A leasehold master title cannot produce freehold strata titles.
For a new launch or a young building, the strata titles may not be issued yet - the master title is the document to read, and its number is quoted in your Schedule H SPA. For a subsale unit in an older building, ask for the strata title; if the seller only has an SPA and Deed of Assignment after many years, that is a separate issue we cover in strata title vs individual title.
One more detail specific to strata: the quit rent on a strata unit is billed as cukai petak (parcel tax) by the state, not through the management. The bill still shows the title reference you need for a search.
What happens when the lease runs low?
The land does not vanish, but your buyer pool and your bank do. Published lending guides say banks commonly want the remaining lease to comfortably outlast the loan tenure - one 2026 guide (Maxxan) cites a rule of thumb of at least 60 years remaining beyond the loan term - and law firm Chia, Lee & Associates notes that properties with under 30 years left trade at a visible discount because financing becomes hard. In practice a short lease turns a property into a cash buyer's market long before expiry.
The fix is a lease extension (lanjutan pajakan), applied for at the state land office before expiry: in Selangor under section 90A of the National Land Code (operative since 1 June 2018) or by surrender and re-alienation under sections 197 and 76. The premium in Selangor is set by state circular as 1/4 x 1/100 x land value x years added x land area - the worked example and current discounts are in our leasehold extension cost guide, and you can estimate your own number with the leasehold renewal calculator.
What you generally cannot do is turn the lease into freehold - that is state discretion, rarely granted, and explained in leasehold to freehold conversion.
Frequently asked questions
What does "freehold" mean in plain terms?
You hold the land in perpetuity - the title says "Selama-lamanya" under Pegangan and there is no expiry date. The state can only take it by compulsory acquisition with compensation.
Is a 99-year leasehold the same as freehold for my lifetime?
Only if most of the 99 years are still ahead of you. What matters is the expiry date on the title today: a 1980 lease has roughly half its term left in 2026, and banks and resale buyers price that in well before expiry.
How do I know if my property is leasehold or freehold without the title?
Run a private land search on your state's portal (Selangor e-Tanah, KL PTGWP e-Tanah, Penang PgLAND, Johor iTanah) using the title number from your quit rent bill. Selangor's private search is listed at RM30. For a new launch, the SPA and brochure state the tenure.
The title says "Pajakan Negeri" but the agent says freehold. Who is right?
The title. Pajakan Negeri is a leasehold title form; read the Pegangan line and the expiry date. If the agent's listing contradicts the title, treat every other claim in the listing with the same suspicion.
Can a leasehold condo become freehold later?
Practically no. Conversion is at the state authority's discretion and is granted only in special circumstances; the realistic path is a lease extension. See leasehold to freehold conversion.
