Serviced apartment vs condo in Malaysia: what one word on the title changes

They can look identical from the balcony. But a serviced apartment sits on commercial title — and that changes your utility tariffs, assessment rates, financing practice and buyer pool. The HDA protection story is better than most articles tell you.

The straight answer

A condo sits on residential title; a serviced apartment sits on commercial title — usually the only real difference, and the one that matters. Commercial title means commercial utility tariffs (TNB's monthly retail charge is RM20 on the non-domestic low-voltage tariff vs RM10 domestic), higher assessment rates (Shah Alam City Council charges 5% on serviced apartments vs 3.5% on stratified residential, per EdgeProp), and a smaller resale buyer pool.

The good news most articles get wrong: a serviced apartment intended for dwelling is still protected by the Housing Development Act — the commercial-land exclusion was removed from Act 118's definition of "housing accommodation" by the 2007 amendment (in force 12 April 2007, per the Malaysian Bar), and the regime was tightened further by the amendments in force 1 June 2015. The practical test: the project holds an APDL and sells under a statutory Schedule H SPA.

What actually differs between a serviced apartment and a condo?

Everything flows from the land title. Here is the side-by-side:

  • Land title: A serviced apartment holds a strata title under commercial land use.
  • HDA (Act 118) protection: The serviced apartment must be intended for dwelling and the developer must hold an APDL - see below.
  • Electricity tariff: TNB RP4 rates from 1 July 2025.
  • Water (Selangor): Air Selangor/Syabas rates, per StarProperty.
  • Assessment (cukai taksiran): Rates vary by council.
  • Maintenance: A serviced apartment shares facilities and insurance with retail/office components in mixed developments.
  • Financing practice: BNM's 70% LTV cap only bites from your 3rd housing loan. On commercial-titled property, banks commonly offer 85% (per Loanstreet), case by case.
  • Bumi quota: Quota treatment differs by state for commercial-titled projects; state minimum purchase prices for foreigners still apply either way.

Does the Housing Development Act protect a serviced apartment purchase?

Yes — if it is intended for human habitation. This is where most comparison articles are outdated. The Malaysian Bar's guidance on the amended housing law states that serviced suites or serviced apartments "intended for human habitation or partly for human habitation and partly for business premises" fall within the definition of housing accommodation, and that "it does not matter if the accommodation is erected on a land designated or approved for commercial development" — the amendment removed those words from the definition (Amendment Act in force 12 April 2007). The amendments in force 1 June 2015 then tightened the whole regime — statutory Schedule G/H contracts, HDA accounts, heavier penalties.

The practical test on any specific launch: does the developer hold a valid APDL (advertising and sales permit) for it, and is the SPA the statutory Schedule H? If yes, your payments go into an HDA account and LAD (late-delivery damages) applies. Pure commercial suites, hotel-suite investment schemes and offices sold without an APDL sit outside Act 118 — that is the real danger zone, not serviced apartments as a class. You can check any project's APDL on TEDUH or in our free checker.

How much more does a serviced apartment cost to run?

Meaningfully more, month after month. The published fixed charges alone tell the story: RM20 vs RM10 a month for electricity, RM36 vs RM6.50 for water in Selangor — and the per-unit commercial rates above those minimums are higher too. Assessment follows the commercial category at most councils (MBSA's 5% vs 3.5% example above), and maintenance fees in mixed-use towers are often heavier because you co-fund facilities with retail and office lots.

Two honest footnotes. First, some owners apply to TNB to reclassify a dwelling-use unit to domestic tariff — myTNB has a change-of-tariff route — but approval is case-by-case and depends on metering; do not price your purchase assuming it succeeds. Second, none of this makes serviced apartments "bad buys" — it makes them cost-heavier, which matters most when the rent you can charge doesn't cover the gap. Run the numbers with our rental yield guide before assuming the gross yield is what you keep.

Who should buy a condo, and who should buy a serviced apartment?

Own-stay family: condo, in most cases. Lower running costs, residential assessment, a calmer resident profile, and — critically — a bigger buyer pool when you sell. Many own-stay buyers simply filter out commercial title, so condos resell to everyone; serviced apartments resell mostly to investors and to buyers who understand the title.

Investor near transit or short-stay demand: a serviced apartment can work. They cluster around malls, offices and LRT/MRT stations where tenant demand is strongest, and some managements permit short-term rental where a condo's house rules would not. The commercial cost structure is then a business expense against rental income — but check the JMB/MC house rules in writing first, and the usual project-level homework still applies: red flags before buying.

Whichever you pick, check the tenure too — commercial title and leasehold are separate axes, and both affect resale: freehold vs leasehold.

Frequently asked questions

Can I live permanently in a serviced apartment?

Yes. Serviced apartments are designed and approved for dwelling — that is exactly why ones intended for habitation fall under the Housing Development Act despite the commercial land title. You just pay commercial-category utilities and assessment unless a reclassification is approved.

Is the loan margin lower for a serviced apartment?

Often, but not always. BNM imposes no LTV cap on commercial property loans, and banks commonly offer 85% on commercial-titled units, though 90% is still possible for strong applicants (per Loanstreet). Some banks treat HDA-covered serviced apartments like residential for margin purposes — ask more than one bank.

Does Bumi quota apply to serviced apartments?

It depends on the state. Quota conditions are imposed at state level, and commercial-titled projects are treated differently from residential ones in some states. Check the specific project's approval conditions — we can do this for you.

Is a serviced apartment harder to resell?

The buyer pool is structurally smaller: own-stay buyers who filter out commercial title, plus buyers whose banks offer a lower margin, drop out. That shows up as longer selling times in a soft market. Price expectations should account for it.

Do foreigners face different rules on serviced apartments?

State minimum purchase prices apply to foreigners regardless of title. Some states apply different conditions to commercial-titled property — the position is state-by-state, so verify against the specific state's consent conditions before committing.
