SOHO vs SOVO vs SOFO vs serviced apartment vs condo in Malaysia: title, HDA cover, bills, loans - and who should buy which

All four "So-" products sit on commercial title. The line that matters is HDA: a SOHO sold as a dwelling gets the Schedule H contract and the Homebuyer Tribunal; SOVO and SOFO are offices you are not supposed to sleep in. Commercial electricity, commercial assessment and commonly lower loan margins apply to all of them.

The straight answer

SOHO, SOVO, SOFO and serviced apartments are built on commercial-titled land; a condominium is on residential title. Among the commercial ones, only units sold as dwellings - SOHO and serviced apartments - fall under the Housing Development Act, so you get the statutory Schedule H sale and purchase agreement, the HDA account, LAD for late delivery and the Tribunal for Homebuyer Claims. SOVO (versatile office) and SOFO (flexible office) are commercial office units: no HDA, no standard SPA, disputes go to court, and they are not designated for living in.

All commercial-titled units pay TNB's non-domestic tariff and commercial assessment rates, and published guides put bank margins commonly at up to 90% for a SOHO under HDA but 70-85% for SOVO/SOFO. If you want a home, buy the condo or a SOHO under Schedule H. If you want a short-stay or office asset with flexible use, the commercial products are built for you - price the bills in.

What do SOHO, SOVO, SOFO, serviced apartment and condo actually mean?

The names are developer marketing; the law only sees two things - what the land title says and whether the unit was sold as a place to live. Per The Edge's explainer on the So-family and the 2015 HDA amendments summarised by law firm Ganzul:

  • Condominium / apartment - residential title, HDA, Schedule H. The baseline everything else is measured against.
  • Serviced apartment - a residence on commercial title, usually in a mixed-use tower. Sold as a dwelling, so under HDA with a Schedule H SPA. The differences from a condo are bills and management, covered in serviced apartment vs condo.
  • SOHO (small office / home office) - a compact unit with a proper living area, bedroom and bathroom on commercial title, usable as a home, an office or both. When sold as residential accommodation it is under HDA - the Housing Development (Amendment) Act 2012, in force 1 June 2015, brought SOHO and serviced apartments explicitly into the framework. A SOHO owner also keeps the once-in-a-lifetime RPGT exemption on a residential sale, which SOVO/SOFO owners do not get (The Edge).
  • SOVO (small office / versatile office) - an office unit with tech fittings, commercial use only; not designated for dwelling. Outside HDA.
  • SOFO (small office / flexible office) - an open-plan unit without partitions, intended as an office that the buyer fits out; outside HDA and not sold as a home even if people end up sleeping there.

The catch: a project's brochure can say "SOHO" while the SPA is a non-standard commercial contract. The test is the SPA - if it is Schedule H, you have HDA cover; if it is the developer's own agreement, you do not. What HDA cover is actually worth is in what is the HDA (Act 118).

  • Electricity - The condo figures are the TNB domestic tariff from 1 July 2025: the energy charge applies up to 1,500 kWh, and the energy-efficiency rebate is for use of 1,000 kWh and below. The non-domestic tariff is the old Tariff B, with its own energy charge and no domestic energy-efficiency incentive - commonly the bigger monthly gap versus a condo.
  • Assessment (cukai taksiran) - The commercial rate is set by the local council - higher than residential for the same floor area.
  • Loan margin - Condo: up to 90% on a first or second home under Bank Negara's rules. SOHO and SOVO / SOFO figures: PropertyGuru, 2026.
  • Stamp duty on transfer - Same ad valorem scale on the purchase price regardless of title type - see stamp duty 2026.
  • Foreign buyers - Commercial title does not escape the state minimum price threshold; the count against the buyer's residential cap may differ - see what foreigners cannot buy.
  • Short-term rental - The Court of Appeal held in 2025 that a commercial serviced-residence title authorises short stays and an MC cannot ban them by house rules - only by a valid special resolution under s.70(2) SMA.
  • Maintenance fees - Typically higher on commercial title: commercial utilities in common areas and heavier mixed-use infrastructure.

One caution on utilities: some guides report that owners of commercial-titled residences can ask TNB or the water operator to reclassify the account as domestic if the unit is used primarily for living. Treat that as case by case, not as something to bank on when you sign.

How much more do the bills really cost on commercial title?

Electricity is the visible one, and the July 2025 tariff restructure widened the gap for light users. Since 1 July 2025 a domestic account pays an energy charge of 27.03 sen/kWh for the first 1,500 kWh (37.03 above), plus 4.55 sen/kWh capacity and 12.85 sen/kWh network charges and a RM10 monthly retail charge - and gets an Energy Efficiency Incentive worth up to 25 sen/kWh rebate when monthly use is 1,000 kWh or below, with the RM10 retail charge waived at 600 kWh or below (per SoyaCincau's summary of TNB's structure). A commercial-titled unit is billed under the Non-Domestic Low Voltage General tariff instead: its own energy charge, the same capacity and network components, and no domestic efficiency rebate. For a one-bedroom used a few hundred kWh a month, losing that rebate is where most of the difference comes from.

Assessment is set by each local council as a percentage of annual value, with commercial property rated higher than residential; the exact rate depends on the council and the tower, so ask for the seller's last bill rather than trusting a rule of thumb. Quit rent is a state charge and is small either way.

Maintenance charges in mixed-use commercial towers run higher than in plain condos because the common areas are billed at commercial rates and the building carries more shared plant. The mechanics of charges and sinking fund, and why a cheap fee is a warning, are in maintenance fees and sinking fund.

None of these kill the case for a commercial-titled unit - they are simply a running cost the brochure omits. Add them to the monthly number before comparing a SOHO at one price with a condo at another.

Who should buy a SOHO, SOVO or SOFO - and who should not?

Buy the commercial product if the use is the point. Reasonable buyers:

  • Short-stay operators. A commercial serviced-residence title is what the Court of Appeal relied on in Wawasan Raya v MARC Service Residence MC (2025) to hold that short-term rental is permitted unless restricted by special resolution - a residential condo gives you no such footing. How to run one legally, and where the traffic is, is in Airbnb and short-term rentals.
  • Small businesses that want an address and a bed. A SOHO under HDA gives you a registrable business premises and a home in one unit, with buyer protection intact.
  • Investors buying the yield spread. Commercial-titled units in Bukit Jalil, Cheras and the city fringe often list below condos of the same size in the same area precisely because own-stay families avoid them; if your tenant base is short-stay or corporate, that discount is your margin. Check the specific tower's occupancy and the MC's stance before assuming it.

Do not buy one as a family home. A SOVO or SOFO is not designated for dwelling and has no HDA cover; a SOHO has the cover but still carries commercial bills, a thinner resale pool of own-stay buyers, and often a hotel-like building with transient neighbours. Own-stay households comparing a SOHO with a condo at a similar price should take the condo unless the SOHO's location wins by a distance. The condo-side checklist is in red flags before buying a condo.

Do not buy a SOVO/SOFO with a residential loan expectation. Published guides put margins commonly at 70-85% and tenures can be shorter; get the bank's letter before the booking fee, and read home loan application for what the bank will ask.

Frequently asked questions

What is the difference between SOHO, SOVO and SOFO?

All are commercial-titled. A SOHO is a small home-office unit with living space, sold as a dwelling under HDA. A SOVO is a versatile office for commercial use only; a SOFO is an open-plan flexible office. Neither SOVO nor SOFO is under HDA or designated for living.

Is a SOHO protected by the HDA?

Yes when it is sold as residential accommodation - the 2012 HDA amendments in force from 1 June 2015 cover SOHO and serviced apartments. Check that your SPA is the statutory Schedule H; if it is the developer's own contract, you are outside HDA.

Do SOHO units pay commercial electricity?

Yes - commercial title means TNB's Non-Domestic Low Voltage General tariff, without the domestic Energy Efficiency Incentive (up to 25 sen/kWh rebate for use of 1,000 kWh and below since 1 July 2025). Some owners apply to TNB for domestic classification; treat that as case by case.

Can I get a 90% loan on a SOVO or SOFO?

Commonly not - published guides put SOVO/SOFO margins at 70-85% on commercial terms, versus up to 90% for a SOHO under HDA. Confirm with the bank before paying a booking fee.

Can I Airbnb a SOHO or serviced apartment?

Commercial title helps: the Court of Appeal held in 2025 that a serviced-residence commercial title authorises short stays and an MC cannot ban them by house rules, only by a valid special resolution. Check the MC's resolutions and any local-authority registration requirement before buying for that purpose.
