Do You Need MM2H to Buy Property in Malaysia? No — And the Causation Runs the Other Way
No. A foreigner buying Malaysian residential property needs no visa, no MM2H, and no long-term residence status. The Ministry of Economy's federal guideline merely lists MM2H purchases as one category exempt from Ministry approval — it is not a precondition for buying.
The real causation runs the other way: MM2H requires you to buy. Silver from RM600,000, Gold from RM1 million, Platinum from RM2 million — and you cannot sell for ten years. You buy the property to get the visa, not the visa to get the property.
The one gate neither route escapes is State Authority consent (Kebenaran Pindah Milik). With or without MM2H you must apply, and without it the dealing is void.
What the official document actually says
In the Garis Panduan Perolehan Hartanah (in force 13 July 2022), "Rumah Keduaku" — the Malay name for MM2H — appears exactly once in the whole document, at Appendix I paragraph 1.1. That paragraph is a list of acquisitions exempt from Ministry of Economy approval.
More decisive is paragraph 2.3: acquisitions by foreign interests of residential units at RM1 million and above per unit do not require Ministry of Economy approval at all — they fall under State Authority jurisdiction.
So the logic is straightforward:
- You buy residential above RM1 million → no Ministry approval needed (nothing to do with MM2H)
- You hold MM2H → also no Ministry approval needed
- Both routes still need State Authority consent
MM2H's role here is not to grant you the right to buy. It removes a federal approval layer in certain cases. For the great majority of people buying residential above RM1 million, you already had that exemption.
Buying directly vs getting MM2H first
The common wrong sequence is: get talked into MM2H first, then go shopping for a house. Three things follow.
- Your home is locked for ten years. All four official tier pages carry the same sentence: after approval you must purchase, and that residence may not be sold for 10 years. The only exit is trading up to something more expensive. If your actual plan was a foothold in Malaysia you might revisit in three to five years, this clause pins you down.
- You may be pushed into the wrong property to satisfy the visa. The floor is the higher of the state and the tier, so your budget gets levered upward. A home bought to hit a threshold is someone else's problem in ten years — except it is yours.
- You paid for something you did not need. If your goal is simply to own a Malaysian property — to rent out, to hold, to house a child at university — the fixed deposit and participation fee bought you nothing on the property side, because you could already buy.
Conversely, if what you actually want is the right to live here, or to work or run a business in Malaysia (Platinum only), MM2H is the correct instrument — just be clear that you are buying a visa, and the property is its condition.
So which route is yours?
Skip MM2H and buy directly — if you want the asset
Rental income, a store of value, somewhere for a child at university, a position taken before retirement. None of those needs a visa. You have three things to handle: the state's minimum price, State Authority consent, and the 8% stamp duty that starts in 2026.
Be clear on one thing: buying grants no residence rights whatsoever. You still enter and leave on ordinary visitor terms.
Take MM2H — if you want to actually live here
Ninety cumulative days a year in Malaysia, family settled here long term, or a business to run locally (Platinum is the only tier that permits work or business). Those are visa problems; a property cannot solve them.
Then accept the ten-year lock as the price, and choose the property on a ten-year test — management quality, incoming supply nearby, transport and schools — not short-term appreciation. Details in MM2H tiers and the property requirement.
The gate both routes share
Either way you must apply for State Authority consent, and states differ enormously on thresholds, permitted property types and levies. Read the state threshold guide before you decide which state to buy in — do it in the other order and much of the work may be wasted.

If the MM2H minimum and the state minimum differ, which applies?
The higher one. Both apply simultaneously and you must satisfy both. For example, Selangor Zone 1's state floor is RM2 million while MM2H Silver is RM600,000 — in Selangor Zone 1 the RM2 million figure governs. Conversely, taking Platinum (RM2 million) in Kuala Lumpur (state floor RM1 million) means the RM2 million figure governs.
